01About The Platform

1.1

The Platform is operated by SISCOM Technology Limited (“SISCOM”, “we”, “us”). It provides information about our products and services and lets you register, submit applications and enquiries, and manage your dealings with us.

1.2

Some services have additional terms, which will be shown to you before you use them.

02Changes To These Terms

2.1

We may update these Terms from time to time. The current version is always available on the Platform. By continuing to use the Platform after a change, you accept the updated Terms.

03Eligibility And Accounts

3.1

You must be at least 18 and able to enter into a binding contract. If you act for a business, you confirm that you are authorised to bind it.

3.2

The information you give us must be accurate, complete and kept up to date.

3.3

You are responsible for keeping your login details confidential and for activity on your account. Tell us promptly if you suspect unauthorised use.

3.4

We may decline any registration or application, and suspend or close any account, where we reasonably consider it necessary.

04Applications And Offers

4.1

Submitting an application, enquiry or expression of interest is a request only. It is not an offer, approval or commitment by SISCOM.

4.2

Any product, facility or investment is subject to our assessment and to the separate written terms that apply to it.

4.3

Nothing on the Platform is financial, legal or tax advice, or a promise of any return. Please take independent advice where appropriate.

05Acceptable Use

5.1

You must not:

  • give false or misleading information, or pretend to be someone else;
  • use the Platform for any unlawful purpose;
  • attempt to gain unauthorised access to accounts, data or systems, or interfere with the Platform's security or operation;
  • upload harmful code;
  • copy or collect data from the Platform by automated means; or
  • use the Platform in breach of these Terms or the law.
5.2

If you do, we may suspend or close your account, refuse your request and report the matter to the relevant authorities.

06Intellectual Property

6.1

All content on the Platform, including text, graphics, logos and software, is owned by or licensed to SISCOM. You may use it for your own dealings with us, but must not copy, change, sell or republish it without our written consent.

07Your Content

7.1

You keep ownership of the documents and information you submit. You allow us to use them to provide our services, meet our legal duties and as described in our Privacy Policy.

7.2

You confirm you have the right to submit them, including any personal data of other people they contain.

08Privacy

8.1

We handle personal data as described in our Privacy Policy, which forms part of these Terms.

09Availability And Third Parties

9.1

We aim to keep the Platform available but do not promise that it will be uninterrupted or error-free. We may suspend it for maintenance or security.

9.2

Parts of our service rely on third parties we do not control, such as payment, banking and telecommunications providers. We are not responsible for their failures or delays.

9.3

The Platform may link to third-party websites. We are not responsible for their content or practices.

10Liability

10.1

To the extent the law allows, SISCOM is not liable for indirect or consequential loss, or for loss caused by events outside its reasonable control or by your own acts or errors.

10.2

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for rights you have under consumer protection law.

11Indemnity

11.1

You will compensate SISCOM for loss and reasonable costs it suffers because you gave false information, used the Platform unlawfully or broke these Terms.

12Suspension And Termination

12.1

We may suspend or close your access if you break these Terms, if the law requires, or if we reasonably suspect fraud or a security risk. You may stop using the Platform or ask us to close your account at any time.

12.2

Closing an account does not affect any separate agreement with us or rights that have already arisen.

13Order Of Precedence

13.1

If these Terms conflict with a signed agreement or with additional terms for a particular service, those terms prevail for that agreement or service.

14Notices And Contact

14.1

We may give you notices through the Platform or using the contact details on your account. You can contact us through the contact page on the Platform.

15Governing Law And Disputes

15.1

These Terms are governed by the laws of the Republic of Kenya.

15.2

We will first try to resolve any dispute through good-faith discussion. Unresolved disputes are subject to the courts of Kenya, unless we agree otherwise in writing.

16General

16.1

These Terms, the Privacy Policy and any additional terms or signed agreement are the whole agreement between us about the Platform.

16.2

If any part of these Terms is unenforceable, the rest continues in force. A delay in using a right is not a waiver of it.

16.3

You may not transfer your rights under these Terms without our written consent.
